A service becomes binding only when the applicable quotation, booking, service agreement, shipping documentation, or other written confirmation has been accepted or issued in accordance with our business procedures.
5. Customer Responsibilities
Customers are responsible for providing complete, accurate, and timely information necessary for the proper handling of their shipment or service request.
- Providing accurate shipper, consignee, contact, origin, and destination information.
- Providing accurate descriptions, quantities, dimensions, weights, and values of goods.
- Providing required commercial, shipping, customs, regulatory, and other documentation.
- Properly declaring goods that are restricted, regulated, hazardous, fragile, valuable, temperature-sensitive, or otherwise subject to special handling requirements.
- Ensuring that the goods comply with applicable import, export, customs, transportation, and other legal requirements.
- Providing timely instructions and approvals necessary for shipment processing.
- Ensuring that packaging is suitable for the nature of the goods and the transportation method, unless packaging services have been specifically agreed with EUR Logistics.
EUR Logistics shall not be responsible for delays, additional costs, penalties, or other consequences arising from inaccurate, incomplete, misleading, or late information or documentation supplied by the customer or another party acting on the customer’s behalf.
6. Freight and Transportation Services
Transportation services may be performed by EUR Logistics, contracted carriers, shipping lines, airlines, trucking companies, warehouses, customs brokers, agents, or other logistics partners.
Transportation schedules, estimated transit times, routing, vessel or flight availability, delivery dates, and other operational information may be affected by weather, congestion, carrier schedules, customs procedures, government actions, mechanical problems, labor disruptions, security requirements, and other circumstances beyond our reasonable control.
Unless expressly agreed otherwise in writing, estimated transit times and delivery dates are not guarantees of arrival.
7. Customs Clearance and Regulatory Compliance
Where EUR Logistics provides customs clearance, brokerage, documentation, or related compliance services, such services are performed based on information and documentation provided by the customer and the requirements applicable at the relevant time.
The customer remains responsible for ensuring that all information relating to the goods is accurate and that the shipment complies with applicable import, export, customs, licensing, taxation, sanctions, and other regulatory requirements.
Customs authorities and other government agencies may inspect, hold, examine, reclassify, assess, seize, or otherwise delay shipments. Such actions may result in additional costs or delays for which EUR Logistics may not be responsible where they arise from government action, inaccurate documentation, cargo characteristics, or circumstances outside our reasonable control.
8. Warehousing, CFS and Storage
Where warehousing, CFS, storage, consolidation, deconsolidation, or related services are provided, the applicable service conditions, agreed storage period, handling requirements, cargo condition, and facility procedures may apply.
Customers are responsible for providing accurate information regarding the nature and condition of goods and for notifying EUR Logistics of any special storage, handling, security, temperature, or other requirements before the goods are received.
9. Cargo Restrictions and Prohibited Goods
Certain goods may be prohibited, restricted, or subject to special approval, documentation, packaging, labeling, handling, insurance, or transportation requirements.
EUR Logistics reserves the right to refuse, suspend, inspect, or require additional information concerning any shipment that may present legal, regulatory, safety, security, environmental, or operational concerns.
Customers must not tender prohibited or restricted goods without making all required declarations and obtaining the necessary approvals.
10. Rates, Charges and Additional Costs
Charges for logistics services are based on the applicable quotation, agreement, tariff, booking confirmation, or other written commercial terms.
Additional charges may arise from circumstances including, but not limited to, storage, demurrage, detention, customs examinations, documentation changes, waiting time, re-delivery, additional handling, special cargo requirements, changes in routing, carrier surcharges, government charges, taxes, duties, or other costs imposed by third parties or authorities.
Where such costs are reasonably incurred in connection with a customer’s shipment or instructions, they may be charged to the customer in accordance with the applicable service terms.
11. Cargo Insurance
Unless expressly agreed otherwise, cargo insurance is not automatically included in the price of logistics or freight-forwarding services.
Customers are responsible for determining whether insurance is appropriate for their goods. Where EUR Logistics offers or arranges cargo insurance, coverage is subject to the applicable insurance policy, terms, conditions, exclusions, and insurer requirements.
12. Liability
EUR Logistics will provide services with reasonable care and in accordance with the applicable service agreement and operational requirements. However, logistics operations involve transportation, handling, customs, warehousing, and third-party service providers, and circumstances may arise that are outside our reasonable control.
To the extent permitted by applicable law, EUR Logistics shall not be liable for loss, delay, damage, additional expense, or other consequences arising from circumstances beyond our reasonable control, including acts or omissions of carriers or other third parties, customs or government actions, weather events, natural disasters, war, civil unrest, strikes, labor disruptions, congestion, infrastructure failures, security incidents, or other force majeure events.
Any liability relating to a specific shipment or logistics service shall be subject to the applicable quotation, service agreement, transport document, carrier terms, applicable law, and any mandatory liability regime that applies to the relevant service.
13. Force Majeure
EUR Logistics shall not be considered in breach of its obligations to the extent that performance is prevented, delayed, or materially affected by circumstances beyond its reasonable control.
Such circumstances may include natural disasters, severe weather, floods, fires, epidemics or pandemics, war, terrorism, civil unrest, government restrictions, sanctions, customs actions, port or airport closures, strikes, labor disputes, transportation disruptions, fuel shortages, cyber incidents, infrastructure failures, or failures of third-party service providers.
